Basic website security measures including recommending an SSL certificate from your Hosting service for the benefit of customers who purchase products and services on your website. M D Moore Marketing has activated your website with more complex User Name and Password protocols to prevent unwanted intrusions or brute force hacking attempts. In addition, “Limit Login” software will be added to protect against brute force attacks by limiting login attempts before blocking them. Client is responsible to request added levels of security should they deem them necessary. M D Moore Marketing is not liable for any loss or damage including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from loss of data, site hacking or malware damage in connection with the use of this website.
Through this website you are able to link to other websites which are not under the control of M D Moore Marketing. We have no control over the nature, content and availability of those sites. The inclusion of any links does not necessarily imply a recommendation or endorse the views expressed within them.
Every effort is made to keep the website up and running smoothly. However, M D Moore Marketing takes no responsibility for, and will not be liable for, the website being temporarily unavailable due to technical issues beyond our control.
1. Estimate. M D Moore Marketing will make every fair attempt to estimate the cost of the project. The estimate is based upon the client’s description of standard and optional services selected – supplied by client via email or signed-off for in the Agreement for Service.
If the client requests more work to be done than what was initially agreed upon, extra time required to make changes to the web site will be added to the bill.
2. Completion Date. As Web Designer on your project, M D Moore Marketing will provide the client with an expected project completion date if requested. We will endeavor to meet any given deadline but we do not guarantee and are not bound in any way to complete the project by this date.
M D Moore Marketing shall not be held responsible for delays to site development arising out of client’s delays in providing graphics, text and all content to web designer. If web site is not completed or work is halted by client’s request, refunds for work completed will be not be given.
3. FEES. Invoices are sent via email on a monthly basis for hourly worked done by M D Moore Marketing as Web Designer. The Client is expected to make payment within 5 (five) business days, unless other arrangements are made with the Web Designer. A $25 late fee will be invoiced if payment is not received. Further, if payment is not received after 30 (thirty) days, the web site may be taken down until payment is received.
It is the responsibility of the client to keep up to date on the M D Moore Marketing services schedule and payment dates.
M D Moore Marketing owns all of their own original design and code of the web site until final payment has been received in full. Once final payment is received, the client will then own the design and code of the web site. Images supplied by client are the responsibility of the client (please see #4)
Client Responsibilities as part of this Disclaimer
4. Website Content. Text for Pages and Posts, and any form of website display (graphics, banners, call-outs, etc.), are the sole responsibility of the client regarding usage, attribution and copyright. Should any legal issues or claims arise from the content or copyright of any images supplied by the client, they will be the sole responsibility of the client.
All images displayed on the client’s web site will only be used after authorization by the client and are the sole responsibility of the client regarding usage and copyright. Client agrees to hold M D Moore Marketing harmless from any and all liability, claims or causes of action arising out of use of the content provided to her by client.
All content created by web designer and/or her subcontractors for client are the property of client. Client hereby grants to the M D Moore Marketing the right to use the work for demonstration of past work performed and/or advertising purposes only.
5. Content by M D Moore Marketing. M D Moore Marketing represents that any graphics originally created by M D Moore Marketing and added to the website that were not supplied by the client are owned by M D Moore Marketing and do not violate United States copyright law. Text created by M D Moore Marketing for the websites Pages or Posts, at the request of the client or as part of the service schedule, must be approved in advance by the client and become the property of the client once posted.
Limitation of Liability
THE MATERIALS AT THIS SITE ARE PROVIDED “AS IS” WITHOUT ANY EXPRESS OR IMPLIED WARRANTY OF ANY KIND INCLUDING WARRANTIES OF MERCHANTABILITY, NONINFRINGEMENT OF INTELLECTUAL PROPERTY, OR FITNESS FOR ANY PARTICULAR PURPOSE. IN NO EVENT SHALL M D MOORE MARKETING, LLC OR ITS AGENTS OR OFFICERS BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF INFORMATION, INJURY OR DEATH) ARISING OUT OF THE USE OF OR INABILITY TO USE THE MATERIALS, EVEN IF M D MOORE MARKETING, LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGES.
